Section 5 <br />IMPACT AIR-5: Will the Project generate air emissions that will exceed <br />Federal General Conformity Rule de minimis thresholds? <br />The 1990 Amendments to Section 176 of the FCAA require the USEPA to <br />promulgate rules to ensure that federal actions conform to the appropriate SIP. <br />These rules, known as the Transportation Conformity Rule and the General <br />Conformity Rule require any federal agency responsible for an action in a <br />nonattainment or maintenance area to detern-rine whether that action conforms to <br />the applicable SIP or whether the action is exempt from the conformity rule <br />requirements. The General Conformity Rule wouNd apply if a federal action would <br />be required and the project is in a federal nonattainment or maintenance area. <br />The General Conformity Rule was updated by USEPA in March 2010. Actions <br />would conform to a SIP and would be exempt from a conformity determination if <br />an applicability analysis shows that the total direct and indirect emissions from a <br />project's activities will be less than specified emission thresholds, known as "do <br />minimis levels. If determined not exempt or not de minimis, the preparation of an <br />air quality conformity analysis could be required to determine conformity. <br />Alternative 1: No Federal Action/No Project <br />Under Alternative 1, the project would not be implemented. There would not be <br />any construction related or operational air quality impacts that could have the <br />potential to exceed the de minimis threshold. The project area would still be <br />classified as a State Non-Attainment Area for ozone, PM 10 and PM2,5 and a <br />Federal Non-Attainment Area for ozone, PM1 0 and PM2,5. <br />Alternative 2: Proposed Project <br />Regional Construction Emissions General Conformity Analysis <br />The results of the criteria pollutant calculations for the Proposed Project <br />construction activities for each phase are shown in Table 10. These values are <br />compared with the General Conformity de minimis annual thresholds. As shown <br />in Table 10, all estimated emissions would be less than the applicable <br />thresholds. It should be noted! that Table 10, conservatively shows all Proposed <br />Project construction emissions in one year.
