E.6.3 Procurement Fee <br /> The successful bidder, as a condition of contract award, will be responsible for <br /> paying the City's solid waste collection service procurement expenses, not to exceed <br /> $25,000, to reimburse the City for its expenses related to procurement of solid waste <br /> collection services, including development of the RFP and Agreement, proposal <br /> review and evaluation, and contract negotiations. Such expenses may include City <br /> personnel, supplies, and consultant fees. <br /> E.6.4 Performance Bond <br /> Upon approval of the Agreement, by the City Council of the City of Santa Ana, the <br /> Contractor shall furnish a Performance Bond within seventy-two (72) hours. The <br /> Performance Bond must be approved by the City of Santa Ana. The performance <br /> bond shall be furnished as security for performance and completion of the work in <br /> accordance with the terms of this RFP and its attachments, the Agreement and its <br /> attachments, in the amount of$2,000,000. <br /> E.6.5 Rights of the City <br /> The City's rights include but are not limited to the following: <br /> a) Issue addenda to the Request for Proposals, including extending or otherwise <br /> revising the timeline for submittal; <br /> b) Withdraw the Request for Proposals; <br /> c) Request clarification and/or additional information from a Contractor at any <br /> point in the procurement process; <br /> d) Execute an agreement with a Contractor, on the sole basis of the original <br /> proposal or any additions to submissions; <br /> e) Reject any or all proposals, waive irregularities in any proposal, modify the <br /> scope, terms and conditions of the proposal as described in this RFP, waive any <br /> requirements of the Request for Proposals, as may be deemed to be in the best <br /> interest of the City; and <br /> f) Reissue the RFP or modify the RFP. <br /> £6.6 Consequence of Submission of Proposal <br /> The submission of a proposal shall not be deemed as an agreement between the <br /> Contractor and the City. Specifically, the following provisions apply: <br /> a) The City shall not be obligated to respond to any proposal submitted nor be <br /> bound in any manner by the submission of a proposal; <br /> Page 29 <br />
