RESOLUTION NO. 58-118 A RESOLUTION OF THE CITY COUNCIL OF THE CITY 01~ SANTA ANA SETTING A HEARING FOR THE PURPOSE 0F DETERMINING WHETHER OR NOT THE PUBLIC CONVENIENCE A~D NECESSITY REQUIRE THE IMPROVEMENT OF MAIN STBE~T WITHIN THE CITY OF SANTA ANA WHEREAS, Section 17 of Article XIII of the Constitution of the State of California provides that the debt limitation and majori- ty protest provisions of said section shall not apply if, after the giving of such reasonable notice by publication and posting and the holding of such public hearing as the City Council of the City of Santa Aha shall have prescribed, said council by no less than a ~/Sths vote of all members thereof, finds and determines that the public convenience and necessity require the improvement proposed to be made; and WNEREAS, Section 2804 of the Streets and Highways Code of the State of California provides that the "Special Assessment In- vestigation, Limitation and Majority Protest Act of 1931" shall not apply to any Proceeding otherwise subject thereto when said improve- ment proceeding is by a charter city and said city has complied with the provisions of Section 17 of Article XIII of the Constitution of the State of California; and WHEREAS, the City of Santa Aha is a charter city of the State of California, NON, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES RESOLVE AS FOLLOWS: SECTION 1. That said City Council proposes to initiate pro- ceedings for the improvement of Main Street between Edinger Street and Delhi Road, all within the City of Santa Ana, by the installa- tion and placing in operation of an ornamental street lighting system including the installation of concrete lighting standards, mercury vapor type luminaires, ballasts, lamps, cable, conduits, pull boxes, and appurtenant work thereto.
