--9-- <br /> <br /> 7267.1. (a) The public entity shall make every reasonable <br /> effort to acquire expeditiously real property by negotiation. <br /> (b) Ileal property shall be appraised before the initiation of <br /> negotiations, and the owner, or his designated represeptative, <br /> shall be given all opportunity to accompany the appraiser <br /> dm'lng }lis inspection of the property. <br /> SEC. 12 Section 7267.2 is added to the Government Code, <br /> to read: <br /> 7267.2. Before the initiation of negotiations for real prop- <br />erty, the public entity slmll establisb an amount which it be- <br />lieves to be just compensation therefor, and shall make a <br />prompt offer to acquire the property for the l'ull amount so <br />established. In no event shall sneb amount be less than the <br />public entity's approved appraisal of the fair market value of <br />sueb property. Any decrease or increase in the fair market <br />wllue of real property to be acquired prior to the date of <br />vahmtion caused by tile public improvemeat for whiel~ such <br />property ~s acquired, or by the likelihood that the property <br />would be atqnired for such improvemeut, other thau that due <br />to physical &qerioration within tbe reasonable control of the <br />owner or occa pant. will be disregarded ii1 determining tile <br />compensation for the property. Tile public eutity shall provide <br />the owner of real property to be acquired with a written state- <br />meut of. and summary of tile basis for. the amount it estabk <br />lisbed as just compensation. Where appropriate, the just cmn- <br />pensation for the real property acquired and for damages to <br />remaining real property shall be separately stated. <br /> Szc. 13. Section 7267.3 is added to the Government Code, <br />to read: <br /> 7267.3. The construction or development of a public <br />provement shall be so scheduled tbat, to tile greatest extent <br />praeticable, no person lawfully occupying real property shall <br />be required to laove frolll a dwelling, assm~ling a replacement <br />dwelling will be available, or to move his business or farm <br />operation, without at least 90 days' written notice from the <br />public entity of the date by which such move is required. <br /> SEc. 14. Section 7267.4 is added to the Government Code, <br />to read: <br /> 7267.-L If the public entity la'rmi~s an owner or tenant to <br />occupy the real property acquired on a rental basis fei' a short <br />term. or for a period subject to tel'ntination by tile public <br />entity on short notice, the amount o~ rent required shall not <br />ex;~'eed the fair rental value of the property to 5 short-ternt <br />occupier. <br /> 81.:c. 15 Section 7267.5 is added to tile Ooverllluell( Code, <br />to read: <br /> 7267.5.
