KLG:ar <br />9/25/79 <br /> <br />RESOLUTION NO. 79-]77 <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SANTA ANA FIXING AND ESTABLISHING THE <br /> COMPENSATION FOR THE OFFICE OF CITY ATTORNEY <br />OF THE CITY OF SANTA ANA, EFFECTIVE JULY 1, 1979, <br />AND REPEALING RESOLUTIONS INCONSISTENT THEREWITH <br /> <br /> WHEREAS, on July 1, 1979, the process of meeting and <br />conferring between authorized representatives of the city <br />and recognized employees organizations was not yet completed; <br />and <br /> <br /> WHEREAS, prior to July 1, 1979 in the course of said <br />process, this Council determined that all salary increases <br />for the current fiscal year should be effective from and <br />after July 1, 1979; and <br /> <br /> WHEREAS, this Council has intended, and now intends, <br />that the salary increase thereinafter specified be effective <br />from and after July 1, 1979, on which date the salary rate <br />for said office was indefinite and subject to future deter- <br />mination, and this Council has been unable to determine said <br />salary adjustment until this date by reason of the fact that <br />insufficient time has been available until the present date <br />in which to consider the matter fully and make the determin- <br />ation hereinbelow set forth. For said reason, this Council <br />finds and determines that said salary adjustment, herein- <br />below specified, shall be retroactive to July 1, 1979. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />the City of Santa Ana: <br /> <br /> 1. That the salary for the office of the City Attorney <br />of the City of Santa Ana is hereby fixed and established at <br />Three Thousand Eight Hundred Forty-four Dollars ($3,844.00) <br />per month. <br /> <br /> 2. That said salary shall be paid in the same manner <br />and at the same time as other monthly salaries in the city <br />are paid, and shall take effect and be paid from and after <br />July 1, 1979. <br /> <br /> 3. That the city shall pay to the Public Employees' <br />Retirement System on behalf of the City Attorney an amount <br />equal to five percent (5.0%) of the compensation upon which <br />the retirement contributions are calculated. Payment there- <br />of is not an increase in base salary. <br /> <br /> 4. In addition to the salary hereinabove fixed and <br />established for said office, said officer shall receive, as <br />additional compensation, the following employee benefits: <br /> <br />(a) Deferred Compensation <br /> <br /> Said officer shall receive as deferred com- <br />pensation an amount equal to one percent (1%) of <br />his or her monthly salary. The amounts contributed <br />by the city under this provision shall be subject <br />to the terms and conditions of the City of Santa <br /> <br /> <br />
