WHEREAS, on June 30, 1977, the City Man~d~v~ to this Council a report concerning a proposed salary adjust- ment for the office hereinbelow specified; and WHEREAS, this Council has intended, and now intends, that said adjustment be effective from and after July 1, 1977, on which date the salary rate for said office was indefinite and subject to future determination, but has been unable to deter- mine said salary adjustment until this date by reason of the fact that insufficient time has been available until the present date in which to consider the matter fully and make the deter- mination hereinbelow set forth. For said reason, this Council finds and determines that said salary adjustment, hereinbelow specified, shall be retroactive to July 1, 1977. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana: 1. That the salary for the office of the City Attorney of the City of Santa Ana is hereby fixed and established at $ 3,520.00 per month. 2. That said salary shall be paid in the same manner and at the same times as other monthly salaries in the City are paid, and shall take effect and be paid from and after July 1, 1977. 3. In addition to the salary hereinabove fixed and established for said office, said officer shall receive, as additional compensation, the following employee benefits: (a) Deferred Compensation Said officer shall receive as deferred com- pensation an amount equal to one percent (1%) of his or her monthly salary. The amounts contributed by the City under this provision shall be subject to the terms and conditions of the City of Santa Ana Deferred Compensation Plan, and subject further to the conditions that: i. Said officer shall not have any vested right in the amounts contributed by the City until termination of employ- ment with City; ii. City will pay the total amount of contributions plus any earnings thereon to said officer upon termination, resigna- tion, retirement, dismissal or death. (b) Health Insurance The City will contribute the following amounts toward the payment of the premiums for said officer and dependents, if applicable, under the existing health insurance program (or a new program providing substantially similar coverage and benefits):
