191 1. For the purpose of this subparagraph B., "discrimination" means denying a client <br />192 or potential client any service, benefit, or accommodation that would be provided to another and <br />193 includes, but is not limited to, the following: <br /> <br />194 a) Denying a client any service or benefit or availability of a facility. <br />195 b) Providing any service or benefit to a client which is different or is <br /> <br />196 provided in a different manner or at a different time fi.om that provided to other clients. <br /> <br />197 c) Restricting a client in any way in the enjoyment of any advantage or <br /> <br />198 privilege enjoyed by others receiving any service or benefit. <br /> <br />199 d) Treating a client differently fi.om others in satisfying any admission <br /> <br />200 requirement or condition, or eligibility requirement or condition, which individuals must meet in <br />201 order to be provided any service or benefit. <br /> <br />202 e) Assignment of terms or places for the provision of services on the basis of <br /> <br />203 ethnic group identification, race, religion, ancestry, color, creed, sex, marital status, national <br />204 origin, age, sexual preference, medical condition, or physical or mental disability of the clients to <br />205 be served. <br />206 2. Compla'mt Process - All complaints alleging discrimination in the delivery of <br />207 services because of ethnic group identification, race, religion, ancestry, creed, color, sex, marital <br />208 status, national origin, age, sexual preference, medical condition, or physical or mental disability <br />209 may be resolved by the State through the State of California's Affirmative Action Complaint <br />210 Process. <br />211 C. Persons with Disabilities - CONTRACTOR agrees to comply with the provisions of <br />212 Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794 et seq., as implemented in Title 45 <br />213 CFR, Section 84.1 et. seq.), pertaining to the prohibition of discrimination against qualified <br />214 persons with disabilities in all programs or activities, and the Americans with Disabilities Act of <br />215 1990 (42 U.S.C. 12101 et. seq.) as they exist now or may be hereafter amended together with <br />216 succeeding legislation. <br />217 D. Retaliation - Neither CONTRACTOR, nor its employees or agents shall intimidate, <br />218 coeme or take adverse action against any person for the purpose of interfering with rights <br />219 secured by Federal or State laws, or because such person has filed a complaint, certified, assisted <br />220 or otherwise participated in an investigation, proceeding, hearing or any other activity <br />221 undertaken to enforce rights secured by Federal or State law. <br /> <br /> <br />
