<br />that is awarded by the arbitrator within thirty (30) <br /> <br />days after the penalty is due and owing to Grantor, <br /> <br />Grantor's City Manager shall have the unconditional <br /> <br />right to draw such amount from the letter of credit <br /> <br />provided by Grantee under Section 8 of this Agreement <br /> <br />(adding Subsection 7.7 to said agreement) upon certi- <br /> <br />fication that Grantee has failed to pay the amount of <br /> <br />the penalty awarded. <br /> <br />upon any such draw from said <br /> <br />letter of credit, Grantee shall forthwith reinstate <br /> <br />said letter of credit to its full amount as required <br /> <br />by Section 8 of this Agreement. <br /> <br />l2. <br /> <br />Subsection 13.5 of said agreement is hereby amended to <br /> <br />read as follows: <br /> <br />"13.5 Institutional Network Grant <br /> <br />Grantor and Grantee acknowledge that certain equipment <br /> <br />and wiring has been purchased and installed at various public <br /> <br />agencies from funding provided by Grantee pursuant to its <br /> <br />obligation to develop a comprehensive plan for utilization <br /> <br />of the Institutional Network. <br /> <br />Such equipment and wiring <br /> <br />installed pursuant to said plan for the Institutional Net- <br /> <br />work are and shall remain the property of Grantor. <br /> <br />Grantee <br /> <br />is hereby relieved of any further obligation to provide <br /> <br />funding of the Institutional Network grant as required by <br /> <br />subsection 13.5 as it read prior to this Agreement. <br /> <br />Grantor <br /> <br />shall be solely responsible for operation and maintenance of <br /> <br />such equipment. <br /> <br />l3. <br /> <br />COMPROMISE AND RELEASE <br /> <br />COMCAST filed a complaint against City in Federal Court <br /> <br />-l4- <br />
