Ana, after due inquiry has ascertained and does hereby determine <br /> <br />that the general prevailing rate of per diem wages in the City <br /> <br />of Santa Ana, which also includes the locality in which the work <br /> <br />described is to be performed in the matter of the construction <br /> <br />of certain improvements in Harbor Boulevard and other streets, <br /> <br />alleys and easements in Assessment District No. 218 in said City, <br /> <br />for each craft or type of workman or mechanic needed to execute <br /> <br />the contract, and also the general prevailing rate for legal <br /> <br />holiday and overtime work for each craft or type of workman or <br /> <br />mechanic, is in accordance with the schedules attached hereto: <br /> <br />Any classification omitted herein shall be paid not <br />less than $ 2.~0 per hour. <br /> <br /> Holiday, Sunday and overtime employment is not usually <br />permitted, but if allowed, wages shall be one and one-half times <br />the above rates. <br /> <br /> The rates of wages, including overtime, holiday and <br />Sunday rates, as just specified, are subject to the effect, if <br />applicable thereto, of executive orders of the President of the <br />United States'No. 9240, dated September 9, 1942, and No. 9350, <br />dated October 3, 1942, to any modifications thereof and to any <br />and all lawful orders of the President or any other authorized <br />Federal Officer or agency, insofar as the same may be applicable <br />to this contract. In case of any inconsistency or omission, the <br />rates fixed by any such applicable Federal order, whether higher <br />or lower, shall control. <br /> <br /> In accordance with the provisions of Section 1777.5 of <br />the Labor Code, ascended by Chapter 971, Statutes of 1939, and <br />in accordance with the regulations of the California Apprentice- <br />ship Council, properly indentured apprentices may be employed <br />in the prosecution of this work. <br /> <br /> The above listed rates are based upon a working day <br />of eight (8) hours, being proportionately applicable to eight (8) <br />hours or less of employment in any one calendar day other than <br />Saturdays, Sundays and the following seven legal holidays: <br /> <br />New Year's Day, Memorial Day, Fourth of July, <br />Labor Day, Armistice Day, Thanksgiving Day <br />and christmas, where any work is required in <br />case of extraordinary emergency caused by fire, <br />flood or danger to life or property. <br /> <br /> For any working time of more than eight (8) hours in <br />any one calendar day and for time worked on Saturdays, Sundays <br />and any of the aforementioned holidays, not less than one and <br />one-half times the specified rates shall be paid. <br /> <br /> APPROVED AND ADOPTED THIS 20th day of April, 1964. <br /> <br />Clerk of the Council of the City <br />of Santa Ana, California <br /> --2-- <br /> <br /> <br />
